Terms of service

1. Agreement

These Terms of Service (“Terms”) govern access to and use of Open Docket (the “Service”), a self-help software product of Securing Public Access to Records and Knowledge, LLC (“we,” “us,” or “our”), a Pennsylvania limited liability company. Website: https://open.rtkldecisions.com.

By creating an account, checking the acknowledgements, or using the Service, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Service.

2. Not a law firm; no legal advice; no attorney-client relationship

Open Docket is a self-help software tool. Securing Public Access to Records and Knowledge, LLC is not a law firm and does not practice law. Nothing in the Service is legal advice. Using Open Docket does not create an attorney-client relationship with Securing Public Access to Records and Knowledge, LLC, with any lawyer, or with anyone else, and does not give you the protections of such a relationship.

Open Docket does not tell you whether or how to make a request or file an appeal. You are responsible for your own requests, appeals, and deadlines. Do not send confidential client information through the Service.

3. Deadlines are estimates

Any date Open Docket shows — including agency response, extension, and appeal dates — is an estimate computed from dates you enter and the Commonwealth holiday calendar. Estimates are labeled as such in the product. You must verify the controlling date against the agency response, the holiday calendar, and the Right-to-Know Law, 65 P.S. §§ 67.101–67.3104. We do not warrant that any displayed date is the statutory deadline.

4. Eligibility

The Service is offered to individuals who are at least 18 years old and located in the United States. The product is designed around Pennsylvania’s Right-to-Know Law. You may use it for other records work at your own risk; we do not represent that the clocks, templates, or routing apply outside that focus.

5. Accounts

You sign in with an email magic link or, if configured, Google. You must provide a valid email address you control. You are responsible for activity on your account. We may suspend or close accounts that violate these Terms.

Before you can use the docket, you must separately acknowledge (1) that Open Docket is not a law firm and does not give legal advice, and (2) that you agree to these Terms, the Privacy Policy, and, if you subscribe, automatic renewal as described at checkout. We store those acknowledgements with document versions, checkbox-text version, a UTC timestamp, and the IP address we received.

7. Subscriptions and billing

The first active request is free. Additional active requests, export, deadline email reminders, and attachments require Open Docket Pro. Published prices are $9 per month or $90 per year, plus applicable taxes.

Subscriptions, when billing is enabled, are processed by Stripe. Stripe is a payment processor; Securing Public Access to Records and Knowledge, LLC does not store full card numbers. Live charges are not enabled until Stripe billing is turned on. When billing is live, subscriptions renew automatically until you cancel.

Monthly plans renew every month and your payment method will be charged $9/month plus applicable taxes until you cancel. Annual plans renew every year and your payment method will be charged $90/year plus applicable taxes until you cancel. There is no minimum term. You can cancel anytime in Account Settings, effective at the end of the current billing period. No partial-period refunds.

At checkout you must separately check an unchecked box authorizing the recurring charge. By subscribing you also agree to these Terms and the Privacy Policy.

8. Acceptable use

Do not use the Service to send confidential client files you would not send through ordinary email, to impersonate others, to abuse agencies or the Office of Open Records, or to violate law. We may suspend accounts that do.

By using the Service, you represent that you are a legal resident of the United States.

9. Your docket

You own the requests, letters, and notes you enter. You are responsible for the accuracy of dates, agency contacts, and the content of letters you send. We may store that content so your docket survives a new browser, as described in the Privacy Policy.

You understand that we may use aggregated or de-identified information derived from the requests, letters, and notes you enter for research and statistics, including possible public display of aggregates that do not identify you, as described in the Privacy Policy.

The Service may assign the per-user relay address assigned in the Service so agencies can send mail about that user’s matters. That relay is not support@rtkldecisions.com and is not a human support inbox. These Terms do not publish a live intake address; the address, when assigned, appears in the Service.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, Securing Public Access to Records and Knowledge, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that estimates, routing suggestions, classifiers, or generated documents are complete, accurate, or legally sufficient.

11. Limitation of liability

To the fullest extent permitted by law, Securing Public Access to Records and Knowledge, LLC is not liable for missed statutory deadlines, agency action or inaction, your decision to send a generated letter, or consequential, incidental, special, or punitive damages. Our aggregate liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or fifty U.S. dollars.

12. Indemnity

You will indemnify and hold harmless Securing Public Access to Records and Knowledge, LLC and its members, officers, and contractors from claims arising out of your use of the Service, your filings, or your violation of these Terms, except to the extent caused by our willful misconduct.

13. Dispute resolution; AAA arbitration; class waiver

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules.

Except for claims that may be brought in small-claims court in Lancaster County, Pennsylvania, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat and venue of arbitration is Lancaster County, Pennsylvania.

YOU AND Securing Public Access to Records and Knowledge, LLC WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Arbitration will proceed on an individual basis only.

If the class waiver is found unenforceable as to a particular claim, that claim must be brought in the state or federal courts located in Lancaster County, Pennsylvania, and not in arbitration.

14. Changes

We may update these Terms. The version number and “Last updated” date will change. Material changes to billing or dispute terms will be posted on this page. Continued use after an update is acceptance of the new Terms. New acknowledgements may be required when the checkbox-text version changes.
